Certification of own manufacture
 

Certification of products (work, services) of domestic manufacture enables manufacturers to exercise their right to get tax and other concessions established by the legislation of the Republic of Belarus.

Mechanism of products (work, services) certification is primarily directed at development of the companies with foreign investments. The Investment Code of the Republic of Belarus provides for customs and tax concessions for such companies involved in manufacture of any goods (work, services).

Moreover, several normative documents establish certain norms regulating customs clearance procedures for any goods of domestic manufacture or raw stuff used for production thereof, as well as the rules of participation in any tenders, taxation issues, etc.

The terms and criteria of assigning any goods (work, services) to goods (work, services) of domestic manufacture have been established by the Regulations of Assigning any Goods (Work, Services) to the Goods (Work, Services) of Domestic Manufacture as approved by Ordinance of the Council of Ministers No. 1817 dated December 17, 2001 “On Approval of the Regulations of Assigning any Goods (Work, Services) to the Goods (Work, Services) of Domestic Manufacture”.

In order to be assigned to goods of domestic manufacture the following conditions have been met for manufacture thereof:

  • the goods shall be manufactured directly by the manufacturer using fixed assets owned or leased by him or used by him on gratis base, necessary materials, raw stuff, semi-finished goods, component parts purchased at the expense of such manufacturer’s own of borrowed funds. Such goods shall be manufactured by the workers being in labour relations with such manufacturer.
  • the goods shall be completely made by the manufacturer or exposed to sufficient reprocessing in the territory of the Republic of Belarus.

The following shall be deemed completely produced goods:

  • treasures of the soil extracted from the country’s bowels or in territorial waters;
  • live animals born and raised in the country;
  • waste and scrap (secondary raw materials) obtained as the result of industrial or any other processing operations;
  • phytogenic products grown or gathered in the Republic;
  • products derived from hunting and fishing; other marine fishing products got by the marine vessel belonging to, or leased/freighted by, the country;
  • high-tech products obtained in the open space at spaceships belonging to, and leased (freighted) by, the country;
    Products derived:
  • in the country from animals raised therein;
  • from fishing and hunting within the Republic;
  • exclusively from catch of marine fishing, produced on board of a processing vessel belonging to, or leased/freighted by, the Republic;
  • from the seabed or marine depth beyond the Republic, provided that the Republic owns exclusive rights to development of such seabed or marine depth;
  • any goods produced in the Republic exclusively from completely manufactured products.

Goods of domestic manufacture exposed to sufficient reprocessing shall be deemed any goods, which reprocessing degree meets one of the following criteria:

  • change of commodity classification code under Commodity Classification for Foreign Economic Activities of the Republic of Belarus at the level of any of the initial four digits;
  • difference between selling price of the manufacturer’s products (taking no account of taxes fixed in accordance with the procedures established by the Ministry of Economy) and the price for raw stuff (materials) used for manufacture of such goods, shall make not less than 30 %;
  • compliance by the manufacturer with necessary conditions of manufacturing and technological operations, upon performance of which the goods shall be deemed originating from the country where such operations have been performed, – in compliance with Annex 1 to the Regulations of Identification of the Country of Origin of any Merchandise, as approved by resolution of the heads of the government of CIS member-states, dated November 30, 2000.

Any products for manufacture of which one or more of the following operations were performed, shall not be assigned to products of domestic manufacture:

  • operations with a view to ensuring safe keeping of goods during storage or transportation;
  • operations with a view to preparing goods for sale and transportation (consignment splitting; shipment formation; consignment taking or gathering; sorting; repacking; fixing of marking, labels or other differential signs to the products or their packaging;
  • simple operations, including dust removal, screening or bolting, sorting, classification, selection (in particular, making sets of products), cleansing, painting, cutting to pieces);
  • simple packing in bottles, flacks, sacks, boxes and other containers; fixing on boards or any other bases);
  • simple junction of parts (units) in order to get finished product;
  • mixing of goods (components) not entailing sufficient difference of so made goods from the original components;
  • slaughter.

Any work and services performed in the territory of the Republic of Belarus or in the territories of any other countries, using:

  • labour of the workers being in labour relations with the manufacturer;
  • fixed assets owned or leased by the manufacturer or used by him on gratis base – shall be deemed work and services of domestic manufacture.

Assignment to goods (work, services) of domestic manufacture shall be confirmed by the certificate issued by the Belarusian Chamber of Commerce and Industry, unitary enterprises of the Belarusian Chamber of Commerce and Industry, their representative office and branches, in accordance with established procedure.
